daily update on the Palworld case
Japanese patent law experts seem to believe it’s likely that Nintendo will use patents revolving around throwing objects to capture creatures, which was granted to them last month, to go after Pocketpair
Now you might think a patent granted in August 2024 might be shaky grounds to use in a lawsuit against a game released in January 2024, but it turns out they had originally filed for the patent in December 2021, so technically it legally could be found to apply to Palworld.
How Nintendo expects to dodge the small issues of Palworld being announced in June 2021, before Nintendo had filed that patent, and the tens of other large games that use that same mechanic (most notably Ark, which is what Palworld is actually closest to mechanically) are yet to be seen.
In other news, Microsoft is making a shit ton of money from Palworld bringing in GamePass subscribers and Sony has directly teamed up with Pocketpair to market and distribute Palworld merchandise, so it’s not entirely unlikely that this could end up seeing Microsoft and Sony actively side with Pocketpair, pitting them against Nintendo. Could be interesting.

i would be surprised if a lawsuit can be successful across countries for this. at best maybe they can ban palworld in japan but i dont think it would make a lot of sense for people to have power to go after businesses in other countries? how would they enforce it? is there some kind of global organization that cares about patents and lawsuits?
the issue is that nintendo is never going to lose against an individual because nobody has that cash
