On Day 1, there will be no extra votes because mafia hasnt made any guesses yet.
Even if they guess Derps tonight correctly, that extra vote will only last in duration of Day 2 and never again be validated extra vote onwards.
With that being said and I assume he is not lying, he should not being tested for lynchproof and the mafia are welcome to attack him any time. Because Derps is saying he should be out of PoE for now.
