so Garry of Garry’s Mod posted that he’s being sued for copyright infringement of Skibidi Toilet.
Boom (creator of Skibidi Toilet) says he has no idea what this is about
Thing is, the lawsuit doesn’t say that Boom is suing Garry, it says that Invisible Narratives, LLC is.
Invisible Narratives acquired the rights for Skibidi Toilet at least to produce toys and make a movie from what I can tell, but I’m assuming IN’s lawyers aren’t complete buffoons, this sort of implies that Boom gave them an exclusive license that included the rights to video games which would have transferred the copyright to IN (hence them referring to themselves as the copyright holder). So, Boom would be telling the truth, but it doesn’t matter because he almost certainly couldn’t stop it unless IN listens to him (I doubt it).
I have literally no idea how the lawsuit will go, but Skibidi Toilet is made using Source Filmmaker (SFM) and this section of the Steam Subscriber Agreement relating to SFM is interesting.
- Valve Game Assets. The assets for Valve games are provided for your personal, non-commercial use in connection with the games, pursuant to the Steam Subscriber Agreement.
Garry’s Mod is a commercial product that uses Valve’s assets, but Valve made an agreement with Garry to sell Garry’s Mod as a standalone commercial product. The Source SDK’s license doesn’t transfer ownership of anything, but states that the licensee may “develop a modified Valve game… but only for free”. Anything in the Steam Workshop for Garry’s Mod (idk if they cost money, I didn’t go that deep) that uses Valve’s assets is also subject to an agreement with Valve where I imagine they don’t transfer any ownership of assets.
IN may have inadvertently purchased the rights to things that Boom didn’t actually possess himself, but I’m not a lawyer and don’t know how this will hold up in court.
