so it’s more accurate to say that Michael Bay is suing Garry Newman which I have to imagine will become Michael Bay suing Valve itself since they’re the publisher of Garry’s Mod and the actual owner of the assets.

He kind of is. Garry Newman made a Source SDK mod that got so popular Valve reached out to make an agreement with him to sell it and split the profits.

I’m not actually sure there’s legal precedent for who owns characters created via a mod using assets they do not legally own.
